Use of site and services
These terms apply to the LAB Acoustics Portal, including public browsing, account access, purchases, consultations, and digital tools.
These Terms & Conditions govern your access to and use of the LAB Acoustics website, shop, digital tools, consultations, mobile experiences, and related services (collectively, the "Portal"). The Portal is owned and operated by LAB Acoustics LLC ("LAB Acoustics," "the Company," "we," "us," or "our"). By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree, you should not use the Portal.
Access to the Portal is generally free unless a specific section, product, service, feature, or experience states otherwise.
Anyone with internet access may browse certain public portions of the Portal using a browser, computer, tablet, or mobile device. Some sections, tools, account areas, pricing features, or services may only be available to registered users or to users who satisfy additional conditions established by LAB Acoustics.
Use of the Portal by registered users is intended for individuals who have reached the age of majority in their applicable jurisdiction and for legal entities acting through duly authorized representatives.
To access certain features, you may be asked to complete a registration form and provide accurate, current, and complete information, including a valid email address and any other information we reasonably request.
- LAB Acoustics may review, validate, or verify registration information before activating an account.
- You authorize us to verify information you provide through internal review procedures and, where appropriate, through relevant third parties or service providers.
- You are responsible for updating your information if it changes.
- We may reject an application, suspend access, or cancel an existing account if information is false, incomplete, misleading, or if use of the Portal creates legal, operational, or security risk.
Usernames, passwords, and account credentials are personal and non-transferable. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- Do not sell, lend, share, or transfer your account credentials to any third party.
- Notify LAB Acoustics immediately if you suspect unauthorized access, credential theft, or misuse of your account.
- LAB Acoustics is not responsible for losses arising from unauthorized use of your credentials caused by your failure to protect them.
You may request account deactivation at any time through the Portal, if that functionality is available, or by contacting us directly. LAB Acoustics may suspend, restrict, or terminate access to any account that violates these Terms, applicable law, or the operational standards of the Portal.
We may modify these Terms in whole or in part at any time. Updated terms may be posted on the Portal, presented at login, sent to the registered email address associated with your account, or communicated by any other reasonable method.
Changes become effective when posted or otherwise communicated unless a different effective date is stated. Your continued use of the Portal after the updated Terms take effect constitutes acceptance of the revised Terms.
All content on the Portal, including software, layouts, text, product copy, graphics, photographs, illustrations, videos, audio, databases, downloads, logos, trademarks, trade dress, and other materials, is owned by LAB Acoustics or used by LAB Acoustics with permission and is protected by applicable intellectual property laws.
- You may not reproduce, republish, distribute, modify, reverse engineer, create derivative works from, or commercially exploit Portal content without our prior written permission.
- Brand names, partner names, logos, and marks shown on the Portal remain the property of their respective owners where applicable.
- Unauthorized use of Portal content may result in civil or criminal liability.
If you upload, submit, transmit, or otherwise provide text, images, project information, room data, measurements, files, comments, or other materials through the Portal, you represent that you own the content or have the rights necessary to provide it.
You retain ownership of your content, but you grant LAB Acoustics a worldwide, royalty-free, non-exclusive license to host, reproduce, store, adapt, process, display, and distribute that content solely as needed to operate, provide, support, market, and improve the Portal and related services.
- You are solely responsible for the content you submit and for ensuring it does not infringe third-party rights or violate law.
- LAB Acoustics may remove or refuse content that it reasonably considers unlawful, offensive, infringing, misleading, or inconsistent with Portal standards.
- You agree to indemnify LAB Acoustics against claims arising from content you submit.
You agree to use the Portal in compliance with applicable law and these Terms. Misuse of the Portal includes, without limitation, the following:
- Reproducing, copying, scraping, or distributing Portal content for commercial purposes without authorization.
- Altering, modifying, or creating derivative versions of the Portal or its content without permission.
- Removing copyright notices, trademarks, or ownership identifiers.
- Using the Portal to send advertising, spam, or unauthorized commercial communications.
- Providing false, misleading, or fraudulent information.
- Interfering with the Portal, attempting unauthorized access, or using the Portal in a manner that could damage LAB Acoustics or third parties.
LAB Acoustics may deny, restrict, or revoke access to the Portal at any time if it believes a user has violated these Terms or created risk for the Company, other users, or third parties.
The Portal may include e-commerce, project galleries, acoustic product information, room-planning tools, immersive audio guidance, calculators, consultation services, and digital design experiences. Product availability, pricing, specifications, estimated lead times, and service descriptions may change without notice.
Any layouts, recommendations, measurements, calculations, drawings, renderings, estimates, or acoustic guidance provided through the Portal are informational only and do not guarantee a specific performance result. Real-world outcomes depend on room conditions, construction, installation, calibration, furnishings, hardware, and other factors outside our control.
THE PORTAL AND ALL CONTENT, PRODUCTS, TOOLS, FEATURES, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. LAB ACOUSTICS DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
LAB Acoustics does not warrant that the Portal will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
To the fullest extent permitted by law, LAB Acoustics will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or related to your use of the Portal.
Where liability cannot be fully excluded, LAB Acoustics' total liability arising out of or related to the Portal will be limited to the amount paid by you to LAB Acoustics for the applicable product or service giving rise to the claim during the 12 months preceding the event, or $100 USD, whichever is greater.
You agree to defend, indemnify, and hold harmless LAB Acoustics, its affiliates, officers, directors, employees, contractors, suppliers, and partners from and against claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Portal, your submitted content, your violation of these Terms, or your violation of any law or third-party rights.
These Terms and any dispute arising out of or relating to the Portal, products, or services will be governed by the laws of the State of Florida, except to the extent preempted by applicable U.S. federal law, without regard to conflict of law principles.
Any dispute that is not subject to arbitration or cannot be heard in small claims court will be resolved exclusively in the state or federal courts located in Florida, unless applicable law requires otherwise.
